Course Description
A case study approach to cover the types and purposes of writing found in an environmental law practice. Students will study and draft a number of the typical documents used in environmental rulemaking, public comments and rulemaking responses, transactional agreements, and environmental litigation. Students will be working from the perspectives of the variety of stakeholders found in environmental law, including property owners, industry, and the general public.
Additional Requirements for Graduate Students:
Graduate law students will not be doing any extra work beyond
that required of the Juris Doctor students. J.D. students are
post-baccalaureate students and the workload expected of them
is the same workload expected of post-baccalaureate graduate
students. Law students are professional students, not
undergraduate students. Graduate law students are primarily
international lawyers seeking expertise in the American legal
system. This expertise is gained through exposure to Juris
Doctor courses.

Course Objectives
Upon successful completion of the course, students will be able to: • Understand the role of administrative agencies in the promulgation and enforcement of environmental regulations; • Understand the role of various stakeholders in the environmental regulatory and rulemaking process.
Topical Outline
• Prepare an internal memo and/or public comment in response to a proposed administrative or agency rule or regulation; • Identify, draft, and review essential environmental contract provisions, including indemnities, assumptions, and representations or warranties in transactional agreements; • Prepare a variety of non-litigation documents that delineate an interested party’s position in requesting a regulatory determination or in responding to a remediation or cessation demand letter; • Draft a motion or brief reflective of typical environmental litigation, e.g., environmental permit appeal
